META Consortium Convenes Stakeholders to Chart Course for PBO Act Implementation in Kenya

Key stakeholders within the META (Meaningful Engagement for Transformative Action) consortium with support from the European Union, gathered over a two-day period for crucial discussions centered on the implementation of the Public Benefit Organizations (PBO) Act in Kenya, which was operationalized on My 14, 2024, 11 years after it was passed.   

This significant legislation provides a comprehensive legal and regulatory framework for Public Benefit Organizations, aiming to enhance their operational efficiency, transparency, and accountability.    

Speaking during the convening, Dr. Laxmana Peter Kiptoo, Director General at Public Benefits Organizations Regulatory Authority (PBORA) emphasized that the regulatory body is committed to fostering a conducive environment for Public Benefit Organizations to thrive while upholding the principles of transparency, accountability, and effective service delivery in line with the PBO Act. 

“We do acknowledge the importance of providing the necessary guidance and support to PBOs to navigate the requirements of the Act working collaboratively with all stakeholders to streamline the operationalization of the PBO Act and create a robust and trustworthy ecosystem for public benefit work,” stated Dr. Kiptoo.  

The PBO Act is a landmark piece of legislation that seeks to create an enabling environment for PBOs in Kenya. By establishing clear guidelines for registration, governance, and reporting, the Act empowers these organizations to better serve their beneficiaries and contribute meaningfully to national development. For Public Benefit Organizations, the Act offers a pathway to greater legitimacy, enhanced access to resources, and stronger partnerships with government and other actors.    

The effective implementation of the PBO Act holds particular significance for African girls and young women. A well-regulated and empowered PBO sector can lead to stronger advocacy for their rights, improved access to education and healthcare, and enhanced opportunities for economic empowerment. Organizations operating within this framework are better positioned to address the specific challenges faced by this demographic and contribute to their overall well-being and advancement. 

The stakeholder forum facilitated an exchange of ideas and perspectives, focusing on critical aspects of the PBO Act’s operationalization. Key conversation points included: 

The convening addressed the role of the META consortium and the broader engagement of Civil Society Organizations in understanding and utilizing the PBO Act to enhance their impact. Discussions also centered on the practical implications of this legislation for CSOs, including navigating registration and compliance while leveraging opportunities for stronger operations and partnerships. Stakeholders emphasized the critical need for the PBO Act to be fully operationalized to unlock its potential for a more effective and accountable PBO sector that ultimately benefits the communities they serve. 

A frank discussion took place regarding the main challenges and successes encountered thus far in the Act’s implementation, recognizing that an honest assessment is vital for shaping future strategies. Participants collaboratively brainstormed concrete, actionable steps that various stakeholders can undertake to accelerate the full implementation of the PBO Act. The forum also identified the diverse key actors crucial to the Act’s success, outlining the specific roles played by government agencies, CSOs, donors, and networks in achieving its objectives. 

Recognizing the importance of inclusivity, stakeholders critically examined potential gaps in representation, seeking to identify and address any underrepresentation to ensure a more equitable and impactful process. Strategies for strengthening collaboration and coordination among government entities, CSOs, donors, and other relevant actors were explored to foster stronger partnerships and avoid duplication of effort. To ensure progress and accountability, participants discussed identifying specific organizations or individuals to lead or co-lead work on key implementation priorities. 

The forum also considered the most effective working structures, such as taskforces or working groups, to facilitate focused action on specific aspects of the PBO Act’s implementation. Mechanisms for ensuring seamless coordination and clear accountability across different working groups and stakeholders were discussed to maintain momentum and track progress effectively. Participants engaged in a focused discussion to identify the top priorities for implementing the PBO Act within the next 6-12 months, defining specific roles for various stakeholders and outlining the necessary support and coordination to translate commitment into action. Finally, the session explored defining indicators of success for the Act’s implementation, highlighting the importance of self-regulating forums and discussing the establishment of robust CSO-led accountability mechanisms to build public trust.  

The highlight of the meeting was the initial drafting of a comprehensive roadmap for the implementation of the PBO Act. This roadmap outlines key priorities, clear timelines, designated roles for various stakeholders, and a robust communications and visibility plan to ensure widespread awareness and engagement. 

The convening of stakeholders under the META consortium marks a significant step forward in the journey towards full operationalization of the PBO Act in Kenya. The collaborative spirit and commitment demonstrated by stakeholders paves the way for a more transparent, accountable, and impactful PBO sector that can effectively contribute to the well-being of all Kenyans, including African girls and young women. The roadmap developed during this session will serve as a guiding document for collective action in the months to come.
